Filing for Bankruptcy

Filing bankruptcy can be an effective way to reduce the amount you have to pay to creditors or eliminate the debt all together.  For individuals it can eliminate or reduce obligations while saving homes, cars and other assets from foreclosure, repossession and attachment.  Income can be protected from garnishment and retirement savings are preserved.  Businesses can reduce the amounts owed to vendors, get rid of burdensome contracts and leases and stretch out payments for back taxes so that they have a chance to return to profitability.

Sometimes, however, a bankruptcy proceeding may not be the best way to resolve financial difficulties.  If there are only a few creditors or the amounts owed are relatively small, or if there are matters that are not best suited to court, workouts can be an effective and speedy way to settle debts.  Direct negotiations with creditors can produce agreements that reduce what is owed and allow the payments to be made over a manageable timeframe.
